Terms of Use – Holiday Home Platform

Preamble

ORM Holiday, a company incorporated under [Jurisdiction] law with its registered office at Abu Dhabi Nejd St (“we,” “us,” or “our”), operates an online platform and mobile application (the “Platform”) through which Guests may book holiday homes, villas, and apartments (the “Properties”) for short-term stays and related services.

These Terms of Use govern the access to and use of the Platform by Guests, as well as the booking and rental of Properties and related services. By using the Platform, making a booking, or otherwise engaging with our services, you (“Guest,” “you,” or “your”) agree to be legally bound by these Terms of Use.

We act as an intermediary between Guests and Property Owners or Property Managers (collectively “Homeowners”), unless otherwise specified. We are not the owner of Properties listed on the Platform, and we are not a party to the Booking Agreement between Guest and Homeowner.


1. Definitions

  • Booking: The reservation of a Property made by a Guest through the Platform.
  • Booking Agreement: The agreement between Guest and Homeowner that governs the stay at a Property.
  • Booking Confirmation: The written confirmation (via email or the Platform) of a successful booking.
  • Concierge Services: Additional services provided directly or through third parties (e.g., transfers, chefs, activities, housekeeping).
  • Guest: The person making a booking.
  • Guest Members: Persons staying at the Property under a Guest’s booking.
  • Homeowner: The legal owner of a Property or their authorized representative/manager.
  • Platform: The website and mobile application operated by us.
  • Services: Intermediary services provided via the Platform, including listing, booking, and ancillary services.

2. Eligibility

Only individuals aged 18 or older with the legal capacity to enter binding agreements may make bookings through the Platform.


3. Booking

3.1 Guests may request bookings via the Platform, mobile app, or by contacting us directly.
3.2 A booking is confirmed only upon (i) Guest’s payment of the required deposit or full booking amount, and (ii) issuance of a Booking Confirmation.
3.3 Bookings are personal to the Guest and cannot be transferred to third parties without our consent.
3.4 Guest details may be subject to verification, and we reserve the right to decline bookings where verification is not satisfactory.


4. Pricing and Fees

4.1 Prices are displayed in the currency indicated on the Platform and include applicable taxes unless otherwise stated.
4.2 The Total Guest Booking Amount includes the rental fee, applicable service fees, cleaning fees, optional concierge or ancillary services, and taxes.
4.3 We may collect fees on behalf of Homeowners and third-party providers.


5. Payments

5.1 Payment terms will be outlined in the Booking Confirmation. Some bookings may require upfront payment; others may allow installment payments.
5.2 Failure to make payments on time may result in cancellation of the booking.


6. Security Deposit

6.1 A security deposit may be required, as detailed in the Booking Confirmation.
6.2 The deposit will be refunded following check-out, subject to deductions for damages, extra cleaning, or breach of terms.


7. Check-in and Check-out

7.1 Arrival and departure times are indicated in the Booking Confirmation. Early check-in or late check-out may be available at an additional cost.
7.2 The Property must be vacated in good condition, with all personal belongings removed.


8. Cancellations and Refunds

8.1 Cancellation terms vary depending on the Property and will be provided at the time of booking.
8.2 Refunds will be processed according to the cancellation policy outlined in the Booking Confirmation.
8.3 If a Property becomes unavailable due to unforeseen circumstances, we will use reasonable efforts to find a suitable alternative.


9. Guest Responsibilities

Guests agree to:

  • Use the Property responsibly and in compliance with local laws.
  • Respect occupancy limits as set out in the Booking Confirmation.
  • Avoid nuisance, disturbance, or unlawful activity.
  • Not host unauthorized events, parties, or commercial activity without prior written consent.
  • Ensure children and minors are supervised at all times.
  • Refrain from smoking or bringing pets unless expressly permitted.

10. Damages and Liability

10.1 Guests are responsible for any damage caused to the Property, furnishings, or surrounding area during their stay.
10.2 Homeowners may deduct repair costs from the security deposit or seek further reimbursement if damages exceed the deposit.
10.3 We act solely as an intermediary and are not liable for losses, damages, injuries, or accidents arising from the use of a Property, except where required by law.


11. Concierge and Ancillary Services

Concierge and ancillary services may be arranged through us or third-party providers. Such services are subject to additional fees and may have separate terms and conditions.


12. Termination of Stay

We or the Homeowner reserve the right to terminate a booking without refund if:

  • Payment is not received as agreed.
  • Guest breaches these Terms of Use or the Property’s rules.
  • The Property is used unlawfully or irresponsibly.

13. Data Protection

Personal data will be collected and processed in accordance with our [Privacy Policy].


14. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Jurisdiction]. Disputes shall be resolved in the courts of [Jurisdiction], unless mandatory consumer protection laws entitle the Guest to bring claims in their country of residence.


15. Amendments

We may amend these Terms of Use at any time. Updates will be posted on the Platform, and continued use of the Platform constitutes acceptance of the updated terms.
